1. Introduction
Welcome to KITANA AI ("we," "our," or "us"). By accessing or using our AI-powered interview and assessment services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use our services.
KITANA AI is an AI-powered interview and assessment platform designed to help organizations streamline their hiring process and help candidates practice their interview skills.
2. Our Services
KITANA AI provides the following services:
- AI-Powered Interviews: Automated voice-based interviews using OpenAI's Realtime API technology
- Candidate Screening: Tools for employers to screen and evaluate job candidates efficiently
- Interview Practice: Practice sessions for candidates to prepare for job interviews
- Performance Reports: Detailed analysis and feedback on interview performance
- Subscription Plans: Various credit-based and subscription-based pricing options
3. User Responsibilities
As a user of KITANA AI, you agree to:
- Provide accurate and truthful information when creating your account
- Maintain the confidentiality of your account credentials
- Use our services only for lawful purposes
- Not attempt to circumvent security measures or exploit vulnerabilities
- Not share your account with others without authorization
- Comply with all applicable laws and regulations
For Employers: You are responsible for obtaining proper consent from candidates before conducting AI-powered interviews and for handling candidate data in accordance with applicable privacy laws.
4. Payment & Billing
Subscription Plans: We offer various subscription plans with different credit allocations. All fees are quoted in South African Rand (ZAR) and are payable via PayFast.
Practice Sessions: Interview practice sessions are available for a one-time fee of R99.
Payment Processing: Payments are processed securely through PayFast. We do not store your payment card details.
Refunds: Due to the nature of our services, refunds are handled on a case-by-case basis. Please contact our support team for refund requests.
Subscription Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period, and you will retain access to any unused credits until their expiration date.
5. Data & Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Candidate Data: Employers are responsible for ensuring compliance with data protection laws (including POPIA in South Africa) when collecting and processing candidate information.
6. Intellectual Property
All content, features, and functionality of KITANA AI are owned by us and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, or distribute our software
- Reverse engineer our technology
- Use our proprietary information for competitive advantage
7. Limitation of Liability
KITANA AI is provided "as is" and "as available" without warranties of any kind, either express or implied.
We are not liable for:
- Decisions made based on AI interview results
- Hiring decisions made by our users
- Any indirect, incidental, special, or consequential damages
- Service interruptions or data loss
Maximum Liability: Our total liability to you for any claim relating to our services shall not exceed the amount you paid to us in the 12 months preceding the claim.
8. Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without cause, with or without notice.
Upon termination:
- Your right to use the services ceases immediately
- We may delete your account and all associated data
- No refund will be provided for partial subscription periods
9. Governing Law
These terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.
10. Changes to These Terms
We may update these Terms & Conditions from time to time. We will notify you of any material changes by posting the new terms on our website and updating the "Last Updated" date.
Continued use of our services after changes constitutes acceptance of the new terms.
